About these terms

Gumleaf Publishing is a business run by Thomas Paul Laurie as a sole trader (ABN 88 336 723 673) in Ballarat, Victoria. On this page, “we”, “us” and “our” mean Gumleaf Publishing, and “you” means the person buying or using our books.

These terms, our Refunds policy and our Privacy page apply to every order. By placing an order you accept them.

We may update these terms. The version on this page when you place an order is the one that applies to that order.

Your order

You must be 18 or over to place an order, or have a parent or guardian’s permission. Please give us a correct email address, because that’s where your book is sent.

Your order is accepted when we email your download link. Until then we may decline or cancel an order, for example if a price is clearly wrong or we suspect fraud. If we do, we refund anything you paid.

Prices and payment

Prices are in Australian dollars. We’re not registered for GST, so our prices don’t include GST and our receipts aren’t tax invoices.

Card payments are processed by Stripe. We never see or store your full card number. We can change our prices at any time, but not for an order we’ve already accepted.

Delivery

After your payment is confirmed, we email a download link to the address you gave at checkout. Each link can be used up to 5 times within 30 days. Please save the file somewhere safe.

If your link has run out, email us with your order number. We’ll send a new one free of charge while the title is still available from us. If the first email hasn’t arrived within 24 hours, check your junk or promotions folder, then contact us.

Please check that your device can open fixed-layout EPUB files before you buy. The books open in Apple Books, Google Play Books and Kobo.

Your licence

When you buy an e-book, you get a personal licence to use it. You can’t transfer the licence, and it doesn’t give you ownership of the book’s copyright. The licence lets you:

  • read the book on devices used by your household
  • read it aloud to your own children and family
  • print pages for your household’s own use

What you can’t do

Unless we agree in writing, you can’t:

  • share, sell, lend or give away the file or your download link
  • upload the book to a website, shared drive, file-sharing service or social media
  • show or read the book to a class, group or public audience, or stream it online
  • copy the text or illustrations into other work
  • use any part of a book to train or test artificial intelligence or machine learning systems

Classroom and school use needs a classroom licence. Schools can order one from their account, and our Classroom licence terms explain what it covers.

If these terms are broken

If we reasonably believe a book has been shared, sold or used in breach of these terms, we may switch off the download links for that order and end the licence. We’ll tell you by email. We won’t refund an order in this case, but this doesn’t affect your rights under the Australian Consumer Law.

School licences

Classroom licences are covered by our Classroom licence terms. Where those terms and these ones differ, the Classroom licence terms apply. A school licence arranged by quote covers the classes named in the quote, for the period stated in it. Our Refunds policy explains the limits on our liability for school purchases.

The stories, illustrations and designs in our books belong to Gumleaf Publishing and are protected by copyright. We keep all rights that these terms don’t expressly give you.

Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or changes those rights. Our Refunds policy explains how we deal with a problem.

Our liability

This section doesn’t limit your rights under the Australian Consumer Law or any other liability that the law doesn’t allow us to limit. Apart from those:

  • we’re not responsible for problems caused by your device, software or internet connection, or by events outside our reasonable control
  • our total liability to you for an order is limited to the amount you paid for it

Disputes and governing law

If something goes wrong, please contact us first so we can try to sort it out. These terms are governed by the laws of Victoria, Australia, and the courts of Victoria can hear any dispute.
