Classroom licence terms

About these terms

These terms are an agreement between Gumleaf Publishing (Thomas Paul Laurie, sole trader, ABN 88 336 723 673) and the school named on the order. Our Terms of sale also apply. Where the two are different, these terms apply to the education package.

By placing an order you confirm you’re allowed to accept these terms for your school. If your school has sent us a purchase order with different terms, these terms apply unless we’ve agreed to the change in writing.

What your school gets

You get a licence to use the package. The books and resources stay the property of Gumleaf Publishing and its author.

• The package includes the three e-books, a teacher resource pack for each book and fifteen worksheets. The worksheets and teacher packs come as PDF and Word files.
• One licence covers one class for one school semester. A class is one group of students and the staff who teach it, including relief teachers, education support staff and specialist teachers working with that group.
• If a teacher uses the package with more than one class, each class needs its own licence.
• Semester 1 access runs until 31 July. Semester 2 access runs until 31 January the following year. Access opens once your payment reaches us.

What you can do

Staff teaching a licensed class can:

• show the e-books on a screen or projector and read them aloud, in the classroom or in a live online or hybrid lesson
• print and photocopy the worksheets and teacher notes for the students and staff in that class
• edit the Word files to suit the class, including simpler or extended versions for particular students
• make accessible versions for students with disability, such as large print, braille or text-to-speech
• keep the files on the school’s password-protected network or learning platform, as long as only staff and students in licensed classes can open them
• keep printed copies and completed student work after access ends

What you can’t do

• Give the e-book files to students or parents, or to anyone outside your licensed classes. Students are welcome to buy their own copy of each e-book from our website to read at home.
• Use the package with a class that doesn’t have a licence.
• Post the e-books, worksheets or your edited versions on a public website, social media or a teaching resource marketplace, or sell or share them outside your school.
• Record a lesson that shows the e-books and share the recording beyond your licensed class.
• Use the books or resources to train an artificial intelligence model, or upload the e-books into an AI tool.
• Remove our copyright notices or the credits for the author.

Your rights under copyright law

Nothing in these terms takes away anything your school is already allowed to do under the Copyright Act 1968. That includes the education statutory licence your school has through Copyright Agency, the exception for teaching in class (section 28) and the exceptions for students with disability.

When your access ends

At the end of your semester the downloads close and the licence to use the e-books and files ends. Unless you renew, please delete the e-book files and the downloaded PDF and Word files, including edited versions, from school devices and learning platforms. Printed copies and student work are yours to keep.

The licence doesn’t renew by itself. We’ll email the account holder about three weeks before access ends so you can decide whether to order again.

Paying

• The price is $200 per class, per semester. Gumleaf Publishing isn’t registered for GST, so no GST is charged and our invoices aren’t tax invoices.
• You can pay by card at checkout or choose Invoice my school. Invoices are due within 30 days, and your downloads open once payment reaches us.
• If an invoice is still unpaid 30 days after it’s due, we may cancel the order. We’ll email you before we do.
• You can add classes at any time during a semester. Each extra class is charged at the full semester price.

Cancelling and refunds

• If you change your mind within 14 days of ordering and nobody at your school has downloaded a file from that order, email us and we’ll cancel it and refund you in full.
• If you ordered more classes than you need, tell us within 14 days of ordering and we’ll refund the extra classes.
• Apart from that, we don’t give refunds for a change of mind, or for classes that end up not using the package, once a file has been downloaded.
• If a file is faulty or won’t open, tell us and we’ll fix or replace it quickly. If we can’t, we’ll refund you for that semester.

Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.

The package is bought for use in a school, and it isn’t the kind of thing people usually buy for personal or household use. So if we fail to meet a consumer guarantee, our liability is limited, where the law allows it and where it’s fair and reasonable, to supplying the resources again or paying the cost of having them supplied again.

Our liability

Apart from your rights under the Australian Consumer Law and any liability the law doesn’t let us limit, our total liability to your school for anything to do with the package is limited to the fees you paid for the semester in question. We’re not responsible for indirect losses, such as time spent re-planning lessons, or for problems caused by your school’s devices, software or internet connection.

If the terms are broken

If we reasonably believe the package is being used in a way these terms don’t allow, for example because the e-book files have been posted online, we’ll contact you and ask you to fix it. If it isn’t fixed within 14 days, or if the use is serious and deliberate, we may end the licence and close your downloads without a refund. Your rights under the Australian Consumer Law still apply.

Changes

• We may update the resources during a semester, for example to fix a mistake or refresh a curriculum link. We won’t take away a book or worksheet you’ve paid for during your semester.
• If we stop offering the package part way through a semester, and it isn’t because of a breach of these terms, we’ll refund the unused part of your fees.
• We may change these terms for future orders. Any change applies from your next order, not to a semester you’ve already paid for.

Privacy

We keep the account holder’s name, school and email address, and any class or teacher names you give us, to supply the package, send invoices and remind you before access ends. Please don’t include student names. Our Privacy policy explains how we handle personal information.

Disputes

If something goes wrong, please email us first and we’ll try to sort it out together. These terms are governed by the law of Victoria, and the courts of Victoria can hear any dispute.
